IBDW FORCES DUPONT TO CORRECT PENSION MISCALCULATIONS

It is a somewhat well known fact that those DuPont employees who retired after August 1, 2008 (but before January 1, 2010) have not been receiving their full pension.  The reason is a result of the inability of Dupont (and Convergys) to add to the employee's wages the amount earned after August 1, 2008.  This failure to add that amount of wages clearly results in a pension that is less than it should be. 

DuPont has acknowledged this problem and has stated, in writing, that it would correct the amount of the pension calculation and pay the additional money with interest to the retirees in question. 

After waiting about one year for Dupont to correct the problem, and with supplemental checks not having been provided to a single retiree, the IBDW filed a lawsuit in Federal Court in Richmond, Virginia to move the process along.  Unfortunately, the Judge accepted DuPont's position that this was an ERISA type case and could only be filed by individuals, not as a class, and threw it out of court. 

Since then, the IBDW counsel has stayed in regular contact with Dupont on this issue and was recently told that "the recalculations are being done chronologically", meaning that those who retired between August 1 and December 31, 2008 should get their supplemental check prior to those who retired in 2009.  At this point in time I have confirmed that at least some of those people who retired in 2008 have in fact received such supplemental checks, including interest.

By the end of June 2010 all those who retired in 2008 should have received their supplemental pension checks. 

For those who retired in 2009, they should have received their supplemental pension check by the end of July 2009.

Those who retired in 2010, they should have been receiving a correctly calculated pension check from the time of their retirement.

The IBDW shall continue to monitor this issue for the impacted Dupont retirees.
